TERMS & CONDITIONS OF SALE 

1. General


These Terms and Conditions apply to all purchases made via this website.

For the purpose of this website, “CND Nursery Group” refers collectively to:

Each entity may supply products listed on this website.

By placing an order, the customer agrees to these Terms and Conditions.

CND Nursery Group reserves the right to amend these terms at any time. The version applicable at the time of purchase will apply.

2. Product Supply and Fulfilment


Products displayed on this website may be supplied by any entity within the CND Nursery Group.

The supplying entity will be responsible for:

  • Product availability
  • Order fulfilment
  • Delivery or collection arrangements

3. Product Availability and Nature of Goods


All products are subject to availability.

Plants are living products and may vary in size, colour, shape, and fullness from images displayed on the website.

If a product is unavailable, the CND Nursery Group reserves the right to:

  • Substitute the product with a similar item of equal or greater value, or
  • Contact the customer to arrange an alternative or refund

4. Delivery Policy


Delivery Areas


Delivery is limited to selected regions. Orders outside standard delivery areas may require a custom quotation.

Delivery Timeframes

  • Processing: 1 to 3 working days
  • Delivery: 2 to 5 working days depending on location

Delivery Conditions

  • A responsible person must be available to receive the order

  • If no one is available:
    • The order may be left in a designated safe location at the customer’s risk, or
    • Re-delivery may be arranged at an additional cost

Distance-Based Deliveries


Orders outside the standard service radius may require manual quoting for delivery and/or installation.

Delays


The CND Nursery Group is not responsible for delays caused by circumstances beyond its control, including weather conditions, supplier shortages, or courier delays.

5. Condition of Plants


All plants are inspected prior to dispatch and supplied in good condition.

Due to the nature of living products, the CND Nursery Group does not guarantee plant survival after delivery.

6. Customer Care Responsibility


Responsibility for plant care transfers to the customer upon delivery.

Customers are responsible for:

  • Proper planting
  • Appropriate watering
  • Suitable soil and environmental conditions

7. Order Cancellations


Orders may only be cancelled prior to dispatch.

Once an order has been prepared or dispatched, cancellation may not be possible.

8. Pricing and Payment

  • All prices are listed in South African Rand (ZAR)
  • Prices include VAT unless stated otherwise
  • Full payment is required before order processing

The CND Nursery Group reserves the right to change pricing at any time without prior notice.

9. Limitation of Liability


The CND Nursery Group is not liable for:

  • Plant failure after delivery
  • Damage caused by incorrect handling or care
  • Indirect or consequential losses

10. Governing Law


These Terms and Conditions are governed by the laws of South Africa, including the Consumer Protection Act.
